New York courts are required to follow the state's child support guidelines for the first $130,000 in combined parental income. If the combined parental income exceeds $130,000, the court has discretion to deviate from these guidelines. The question then becomes: should the court apply the child support guidelines to all of the parental income, or should the payor parent pay a higher or lower percentage on amounts greater than $130,000? There are other issues as well. Should the parent paying child support pay for private school or post-secondary education expenses? Should the parent paying child support pay for other expenses such as child care? These issues can become very complex very quickly.
